The O’Brien Law Firm has filed suit in Harris County District Court on behalf of a former employee against Sitewide Project Solutions LLC and its president, Gary Pio Hartnett.

The lawsuit alleges that the plaintiff was hired in February 2025 as a Commissioning Manager for the Crusoe Longhorn Project in Abilene, Texas. According to the petition, the employee's compensation included hourly pay at a rate of $150 per hour and a bonus equal to five percent of the project’s gross margin.

The suit alleges that the plaintiff substantially expanded the value of the project for Sitewide, increasing the size of the contract by approximately twenty-six times the original amount, thereby generating millions of dollars in additional revenue for the company.

However, as alleged, the employment relationship later deteriorated as the company delayed payment of wages and reimbursements and ultimately refused to pay the plaintiff any bonus tied to the project (which is estimated to be between $100K-$200K). He resigned in January 2026 after concluding that the company would not honor its compensation commitments.

The lawsuit also alleges that O'Brien's client regularly worked more than forty hours per week but was typically paid only his regular hourly rate for overtime hours rather than the legally required overtime premium. Although the employee had a relatively high hourly rate, the law still requires that he be paid time-and-one-half his regular rate for hours over 40.

The lawsuit asserts claims for breach of contract relating to the unpaid bonus and violations of the Fair Labor Standards Act for unpaid overtime compensation. The O'Brien Law Firm is working to recover the client's unpaid project bonus, unpaid overtime wages, liquidated damages, and attorney’s fees.

The case is docketed as Cause No. 2026-15074, in the 165th Judicial District Court of Harris County. As is common at the outset of litigation, the Defendants are expected to deny the allegations in the lawsuit.
